TERMS & CONDITIONS

 

By using our website and placing an order for items electronically, you confirm your agreement to our terms and conditions.

 

1 RETURNS POLICY

 

Please contact Mama Loves before returning any items.

You can return the product within 30 days of delivery. The product must be in new condition. If the product is ruined or used the product shall not be refunded. Make sure to include contact information with the return and if possible, please provide us with a tracking number and a brief description of your case.

 

Mama Loves suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed. Mama Loves will make a refund of eligible returns. If you paid by invoice, we will need a bank account number to transfer the money back to. The easiest way is to e-mail it to us.

 

1.2 NON RETURNABLE GOODS

 

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases. Additional non-returnable items are: Gift cards, downloadable software products, some health and personal care items.

 

1.3 SHIPPING

 

To return your product, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer. You should mail your product to: Mama Loves, 27 Swinhoe Place, Culcheth, Warrington, WA3 4NE, United Kingdom

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

 

If you are shipping an item over £50, you should consider using a trackable shipping service or purchasing shipping insurance. We don't guarantee that we will receive your returned item.

 

 

2 REFUND POLICY

 

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can't offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

 

2.1 REFUNDS

 

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

 

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

 

2.2 PARTIAL REFUNDS

 

There are certain situations where only partial refunds are granted (if applicable): Book with obvious signs of use, CD, DVD, software, video game or record that has been opened. Any item not in its original condition, is damaged or missing parts for reasons not due to our error. Any item that is returned more than 30 days after delivery.

 

2.3 LATE OR MISSING REFUNDS

 

If you haven't received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you've done all of this and you still have not received your refund yet, please contact us at: online-shop@mamalovesboutique.com.

 

2.4 SALE ITEMS

 

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

 

2.5 EXCHANGES

 

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at online-shop@mamalovesboutique.com and send your item to: Mama Loves, Warrington, WA3 4NE, United Kingdom

 

2.6 GIFTS

 

If the item was marked as a gift when purchased and shipped directly to you, you'll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

 

If the item wasn't marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

 

2.7 LIMITATION OF LIABILITY

 

We will use all reasonable endeavours to carry out obligations within a reasonable period of time but will not be liable to you, the buyer for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of this Agreement by reason of any delay in performing, or any failure to perform, any of its obligations in relation to this Agreement, if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following will be regarded as causes beyond our reasonable control:


2.7.1.1 Act of God, explosion, flood, tempest, fire or accident;

2.7.1.2 War or threat of war, sabotage, civil disturbance or requisition;

2.7.1.3 Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;

2.7.1.4 Import or export regulations or embargoes;

2.7.1.5 Strikes, lock outs or other industrial actions or trade disputes;

2.7.1.6 Difficulties in obtaining raw materials, labour, fuel, parts or machinery;

2.7.1.7 Power failure or breakdown in machinery.

If we are prevented from carrying out our obligations in the above circumstances, we will notify you in writing. If we are still prevented from carrying out its obligations 3 weeks from the date such notice was sent, then either party may give written notice to the other cancelling the Agreement. If the Agreement is cancelled in this way we accept no liability to compensate you for any loss or damage caused by failure to perform.

 

Except where you, the buyer are dealing as consumer (as defined in the Unfair Contract Terms Act 1977 section 12 as amended) we do not give any warranty, guarantee or indemnity as to quality, fitness for purpose or otherwise of the item(s).
Except in respect of death or personal injury caused by our negligence, we will not be liable to you, the buyer, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of item(s) other than as a result of a breach of an obligation arising under the Sale of Products Act 1979 (as amended) and the Supply of Products and Services Act 1973.

 

3. PRIVACY POLICY

 

3.1 WHAT DO WE DO WITH YOUR INFORMATION?

 

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

 

When you browse our store, we also automatically receive your computer's IP address in order to provide us with information that helps us learn about your browser and operating system.

 

3.2 EMAIL MARKETING

 

With your permission, we may send you emails about our store, new products and other updates.

 

3.3 CONSENT

 

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

3.6 ONE.COM

 

Our store is hosted by One.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through One.com's data storage, databases and the general One.com application. They store your data on a secure server behind a firewall.

 

3.7 PAYMENT

 

If you choose a direct payment gateway to complete your purchase, then our third-party payment gateway might use your credit card info for that purpose. See 3.8.

 

3.8 THIRD-PARTY SERVICES

 

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

3.10 SECURITY

 

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

 

 

 

4 ORDERS

 

An order for items placed by you, the buyer, through our website shall be subject to these terms and conditions
All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law
Nothing in these terms and conditions shall affect the statutory rights of any consumer.

 

4.1 ORDERS

 

All orders for items shall be deemed to be an offer by you, the buyer, to purchase items pursuant to these terms and conditions.
You, the buyer, shall be responsible for ensuring the accuracy of the details provided on the order form and we will not be obliged to accept an order unless all details requested have been entered correctly.

 

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, just a confirmation that we have received it.
Unless you cancel your order, acceptance of your order and completion of the contract will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Warrington, England and the language of the contract is English.
We are entitled to refuse any order placed by you and will not be required to provide an explanation.
By placing your order you warrant that you are over 18 years old and that you have capacity to enter into this contract.

 

4.2 PRODUCTS

 

The items may differ slightly from the images shown on the website. Without prejudice to the generality of the foregoing you accept that, without limitation, the colour tone, fabrication and visual aspects of the items may differ from the images displayed on the website. You accept that there may be differences in the actual appearance of the items from the images on the website this is usually due to photographic technique and context.
We reserve the right to substitute items of a similar description and standard if the requested items are not available but will use reasonable endeavours to match your order exactly. In the unlikely event of you receiving a substituted product you, the buyer, shall be entitled to return the product within 7 working days from the date of delivery, should the substituted product not be acceptable to you. Provided the conditions of clause 25 (below) are satisfied you will then receive a full refund for the returned substituted product.
We reserve the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

 

4.3 PRICING POLICY (Price and Payment)

 

The price of the items will be the prices quoted on the website at the date the order is received, delivery prices vary.
We reserve the right, by giving notice to you, the buyer, at any time before delivery to increase the price of the items to reflect any increase in the cost to us, which is due to any factor beyond our control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials, costs of obtaining customs clearance or other certifications or other costs of manufacture).
In the unlikely event of there being such an increase in the price of the items you, the buyer, shall be entitled to cancel the order at any time before delivery.

 

4.4 PAYMENT

 

When we provide any items to you, the buyer, under these terms and conditions, payment will be charged to the credit card account provided by you on the website order form.
By placing an order, you, the buyer, consent to payment being charged to your credit card account as provided.
Title to the items will pass to you, the buyer, on payment in full of the price of the items.
We will issue you with an electronic receipt together with a dispatch notice by email once the transaction is completed and will send you a further email once the item(s) have been dispatched.

 

4.5 DELIVERY

 

The item(s) will be delivered to you, the buyer, at the address provided by you on the order form.
The risk in the item(s) shall pass to you upon such delivery taking place.
Any dates quoted for delivery of the item(s) are approximate only and we shall not be liable for any delay in delivery of the item(s) however caused. If however we are unable to deliver your item(s) by the date quoted for delivery you, the buyer shall be entitled to cancel the order at any time before delivery takes place.
We shall not be liable to you, the buyer, for incomplete delivery of the item(s)however caused but will provide you with the outstanding item(s) as soon as is reasonably practical. If however we have not delivered the outstanding item(s) within 7 days from the first date of delivery you, the buyer, shall be entitled to cancel the order for the outstanding item(s).

 

5 CHANGES TO THESE TERMS OF SERVICE

 

We reserve the right to modify our terms of service at any time, so please review it frequently.

 

Changes and clarifications will take effect immediately upon their posting on the website.

 

If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

 

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
